Definitions
Art for Planet Earth (“We”, “Us”) – a not-for-profit Unincorporated Association that operates an online platform dedicated to showcasing and promoting environmentally inspired artwork, hosting art competitions and facilitating the sale of artwork.
Artist – a creative person who has submitted a work of art to an exhibition, gallery or competition and has listed that work for sale on the Art for Planet Earth website.
Buyer (“You”) – a person or entity that goes through the buying process for a work of art listed on the Art for Planet Earth website.
These Buyer Terms & Conditions apply when you purchase or attempt to purchase a work of art via the Art for Planet Earth website. By completing a purchase, you agree to these Terms in addition to our general Terms of Use.
1. Eligibility to Buy
You confirm that you are legally capable of entering into a binding contract and, if purchasing on behalf of an organisation, that you have the authority to do so.
2. Our Role
Art for Planet Earth provides a web-based platform that connects buyers and artists. We act solely as an intermediary and facilitator.
The contract of sale is directly between you and the artist. Art for Planet Earth is not the seller, does not take ownership of the artwork, and does not provide guarantees as to the condition, quality, or suitability of the artwork beyond what is described in the listing.
3. Artwork Listings & Descriptions
Artwork descriptions, images, pricing and availability are provided by the artist. While we take reasonable steps to maintain platform integrity, we do not independently verify listings.
You acknowledge that artworks may vary slightly from images shown due to lighting, screen calibration, or the nature of handmade works. Please contact the artist if you have any questions about the work.
4. Pricing & Fees
The purchase price of an artwork is set by the artist and displayed at the time of purchase. Prices are exclusive of any applicable taxes, duties, customs charges, or delivery fees unless otherwise stated.
Any additional fees payable by the buyer will be clearly shown before checkout.
5. Payments & Escrow
Payments are processed securely via Monek or another approved payment provider.
Funds are held in escrow by Art for Planet Earth and released to the artist only after:
- the artwork has been delivered; and
- you have confirmed safe receipt and acceptance, or a reasonable acceptance period has elapsed without dispute.
6. Delivery
Unless otherwise stated, the artist is responsible for packaging, shipping and insuring the artwork.
Estimated delivery times are provided by the artist and are indicative only. Art for Planet Earth is not responsible for delays caused by shipping carriers, customs processes, or events beyond reasonable control.
7. Inspection & Acceptance
Upon receipt, you should inspect the artwork promptly.
If the artwork arrives damaged, materially misdescribed, or not as listed, you must notify Art for Planet Earth within the acceptance period specified at checkout (or, if none is specified, within a reasonable time).
Failure to raise a concern within this period may be treated as acceptance of the artwork.
8. Cancellations, Returns & Refunds
Cancellation, return and refund policies are set by the artist and will be displayed at the point of purchase.
Where returns are accepted:
- the artwork must be returned in its original condition;
- return shipping arrangements and costs will be specified in the artist's policy;
- refunds will be processed once the artwork is safely returned and inspected.
Art for Planet Earth may deduct reasonable administrative costs where applicable.
9. Risk & Title
Title to the artwork passes to you once full payment has been made and the artwork has been delivered, subject to any return rights.
Risk of loss or damage passes according to the artist's stated delivery terms.
10. Taxes & Duties
You are responsible for any applicable taxes, import duties, customs charges or similar fees arising from your purchase. Art for Planet Earth does not provide tax advice.
11. Copyright & Usage
Unless expressly stated otherwise, purchasing an artwork does not transfer copyright.
Copyright remains with the artist. You may not reproduce, distribute, or commercially exploit the artwork without the artist's prior written consent.
12. Buyer Conduct
You agree not to:
- engage in fraudulent, abusive or deceptive behaviour;
- misuse the platform or interfere with transactions;
- attempt to circumvent platform fees or escrow processes.
We reserve the right to suspend or terminate access for breaches of these Terms.
13. Limitation of Liability
To the fullest extent permitted by law, Art for Planet Earth shall not be liable for:
- disputes between buyers and artists;
- loss or damage to artworks during transit;
- inaccuracies in artwork descriptions provided by artists.
Nothing in these Terms limits liability that cannot lawfully be excluded.
14. Changes to These Terms
We may update these Terms periodically. Continued use of the platform or completion of purchases after changes take effect constitutes acceptance of the revised Terms.
